Anhang zum Jahresabschluss auf den 31.12.2009Berliner Eigenheimbau GmbHI. Allgemeine Angaben zum Jahresabschluss Der Jahresabschluss zum 31.12.2009 der Berliner Eigenheimbau GmbH wurde auf der Grundlage der Bilanzierungs- und Bewertungsvorschriften des Handelsgesetzbuches aufgestellt. Die Gesellschaft ist nach den Größenkriterien des § 267 Abs. 1 HGB eine kleine Kapitalgesellschaft. Die als "Verbindlichkeiten gegenüber Unternehmen, mit denen ein Beteiligungsverhältnis besteht" ausgewiesenen Beträge wurden in 2009 zu den entsprechenden Finanzanlagen umgegliedert. II. Angaben zur Bilanzierung und Bewertung einschließlich der Vornahme steuerlicher Maßnahmen Die Bewertung wurde unter der Annahme der Fortführung der Unternehmenstätigkeit (§ 252 Abs. 1 Nr. 2 HGB) vorgenommen. Das Finanzanlagevermögen (Beteiligungen) wurde mit den Anschaffungskosten bzw. dem am Bilanzstichtag niedrigeren beizulegenden Wert angesetzt. Das zum Verkauf bestimmte Grundstück wurde unter Beachtung des strengen Niederstwertprinzips bewertet. Forderungen und sonstigen Vermögensgegenstände sind mit dem Nennwert bzw. mit dem am Bilanzstichtag niedrigeren beizulegenden Wert angesetzt. Die Guthaben bei Kreditinstituten sind zum Nennwert angesetzt. Die Verbindlichkeiten wurden zum Rückzahlungsbetrag angesetzt. III. Angaben und Erläuterungen zu einzelnen Posten der Bilanz Forderungen und sonstige Vermögensgegenstände haben eine Restlaufzeit von einem Jahr. Die in Höhe von Euro 56.153,35 ausgewiesenen Forderungen aus Grundstücksverkäufen wurden an ein nahestehendes Unternehmen abgetreten (vergleiche unten: "Verbindlichkeiten gegenüber nahestehende Unternehmen"). Verbindlichkeiten mit einer Restlaufzeit von mehr als einem Jahr und durch Grundpfandrechte gesicherte Verbindlichkeiten bestanden am Bilanzstichtag nicht. In den Verbindlichkeiten aus Lieferungen und Leistungen sind Verbindlichkeiten (rund Euro 51.900,00) gegenüber Gesellschaften enthalten an den Gesellschafter der Berliner Eigenheimbau GmbH beteiligt sind. Für die Verbindlichkeiten gegenüber nahestehenden Unternehmen wurde teilweise ein Rangrücktritt gewährt. Bei Kommanditgesellschaften, an denen die Gesellschaft als Kommanditistin beteiligt ist, besteht keine Haftung über die geleistete Einlage hinaus. Die Gesellschaft haftet persönlich, quotal entsprechend ihrer eigenen Beteiligung an Fondsgesellschaften (Personengesellschaften) für die von diesen aufgenommenen Kredite. IV. Sonstige Angaben Während des abgelaufenen Geschäftsjahrs waren Herr Dipl.-Ing. Hellmuth Claus (alleinvertretungsberechtigt) und Herr Dipl.-Kfm. Dino Kirchmeier Geschäftsführer.
