ANHANG zum Jahresabschluss zum 31.12.20091. In Abstimmung mit dem Geschäftsführer wurde nur eine Handelsbilanz erstellt, da in einer Steuerbilanz keine abweichenden Angaben zu machen wären. 2. Das Anlagevermögen wurde um die planmäßige Abschreibung gemindert angesetzt. 3. Die sonstigen Forderungenund die Verbindlichkeiten wurden mit dem Teilwert angesetzt. Bis zur Bilanzerstellung sind diese Beträge ausgeglichen, so sie fällig waren. 4. Gemäß §267 HGB handelt es sich um eine kleine Kapitalgesellschaft. 5. Die Rückstellungen wurden im Rahmen der steuerlichen Möglichkeiten gebildet. 6. Die Aufwendungen und Erträge der Gewinn- und Verlustrechnung sind üblich. 7. Während des abgelaufenen Geschäftsjahres wurdedie allgemeine Geschäftsführung durch Herrn Frank Müller wahrgenommen. Die Prokura hat Herr Reinsch erhalten. 8. Neben dem Geschäftsführer wurden durchschnittlich 4 Arbeitnehmer beschäftigt. 9. Die GmbH ist mit EUR 52.007,50 überschuldet. Es besteht ein Darlehen von einer Angehörigen des Geschäftsführers in Höhe von € 20.000,00. Auf die Rückzahlung des Darlehens wird so lange verzichtet, bis die GmbHnicht mehr überschuldet ist. Ebenfalls hat der Geschäftsführer auf den Namen der GmbH ein Darlehen in Höhe von € 26.297,69 aufgenommen, welches er persönlich tilgt. Auf die Rückzahlung dieses Darlehens verzichtet er solange die GmbH überschuldet ist. Der Geschäftsführer hat noch weitere Forderungen in Höhe von ca. € 16.000,--. Die Tilgung der Forderung wird zurückgestellt, bis die GmbH nicht mehr überschuldet ist. Berlin, den 29. Juni 2010 Frank Müller
