ANHANG für das Geschäftsjahr 2009der Tivaris GmbHJ. Allgemeine Angaben zum Jahresabschluss Der Jahresabschluss zum 31. Dezember 2010 ist gemäß den Vorschriften des Handelsgesetzbuches und des GmbH-Gesetzes aufgestellt. Für die Gewinn- und Verlustrechnung wurde das Gesamtkostenverfahren gemäß § 275 Abs. 2 HGB angewandt. Bei der erstmaligen Aufstellung des Jahresabschlusses nach dem Bilanzrechtsmodernisierungsgesetz (BilMoG) wurden die Vorjahresvergleichszahlen auf Grund des Wahlrechts des Art. 67 Abs. 8 Satz 2 EGHGB nicht angepasst, ausgenommen davon ist der Ausweis des Bilanzpostens "nicht eingeforderte ausstehende Einlage" unter PASSIVA, A. Eigenkapital, I. Gezeichnetes Kapital gegenüber dem Vorjahresausweis unter AKTIVA A. "Ausstehende Einlagen auf das gezeichnete Kapital". Die Gesellschaft ist eine kleine Kapitalgesellschaft gemäß § 267 Abs. 1 HGB. Für die Aufstellung wurden die größenabhängigen Erleichterungen gemäß §§ 274a, 288 HGB für kleine Kapitalgesellschaften teilweise in Anspruch genommen. 11. Erläuterungen und Angaben zu Bilanzierungs- und Bewertungsgrundsätzen Der Jahresabschluss ist hinsichtlich Bilanzierung und Bewertung unter der Annahme der Fortführung der Unternehmenstätigkeit (going cancern; § 252 Abs. 1 Nr. 2 HGB) aufgestellt worden. Dem Jahresabschluss liegen nachstehende Bewertungsgrundsätze zugrunde: Die Forderungen und die sonstigen Vermögensgegenstände sind zu Nennwerten angesetzt. Das gezeichnete Kapitalist zum Nennbetrag angesetzt. Die sonstigen Rückstellungensind für alle weiteren ungewissen Verbindlichkeiten gebildet. Sie sind mit dem Erfüllungsbetrag bewertet. Die Verbindlichkeiten gegenüber Kreditinstitutensind zum Nennwert angesetzt. Verbindlichkeiten wurden zum Erfüllungsbetrag angesetzt. 111. Erläuterungen zur Bilanz Die Restlaufzeiten der Forderungen und Verbindlichkeiten betragen nicht mehr als ein Jahr. Haftungsverhältnisse Zum Abschlussstichtag bestanden keine sonstigen Haftungsverhältnisse nach § 251 HGB (Eventualverbindlichkeiten). . Sonstige Angaben Während des abgelaufenen Geschäftsjahres wurden die Geschäfte des Unternehmens durch Herrn Andre Wandel, Frankfurt am Main, geführt. Er ist alleinvertretungsberechtigt und von den Beschränkungen des § 181 BGB befreit.
