Handelsrecht Anhang1. Allgemeine Angaben Der Jahresabschluss ist nach den Vorschriften der §§ 242 ff. und der §§ 264 ff. HGB aufgestellt. Die Gliederung der Bilanz erfolgt im Rahmen der Vorschriften in § 266 Abs. 2 und 3 HGB. Die Gliederung der Gewinn- und Verlustrechnung erfolgt nach § 275 Abs. 2 HGB (Gesamtkostenverfahren). Von den größenabhängigen Erleichterungen wurde Gebrauch gemacht. So hat die Gesellschaft als kleine Kapitalgesellschaft auf die Aufstellung eines Lageberichtes verzichtet. Die Gesellschaft ist bilanziell überschuldet, jedoch liegt eine Überschuldung gemäß § 19 InsO insoweit nicht vor, da entsprechende Nachrangigkeitserklärungen für die Gesellschafterdarlehen abgegeben wurden. 2. Bilanzierungs- und Bewertungsmethoden Die Bewertung der Vermögensgegenstände und Schulden wird entsprechend den handelsrechtlichen Bewertungsvorschriften unter Beachtung der Grundsätze ordnungsmäßiger Buchführung und Bilanzierung vorgenommen. Aktivierungswahlrechte und Passivierungswahlrechte werden nicht in Anspruch genommen. Das Sachanlagevermögen wird zu Anschaffungs- oder Herstellungskosten, vermindert um planmäßige Abschreibungen, angesetzt. Vorräte werden zu Anschaffungskosten unter Beachtung des Niederstwertprinzips bewertet Die Bewertung der Forderungen und sonstigen Vermögensgegenstände erfolgt zu ihrem Nominalbetrag. Bei der Bemessung der Rückstellungen wird allen erkennbaren Risiken ausreichend und angemessen Rechnung getragen. Verbindlichkeiten sind mit dem Rückzahlungsbetrag angesetzt. 3. Sonstige Angaben Geschäftsführer ist der Kaufmann Herr Daniel Roger, Berlin. Der Abschluss wird in den Konzernabschluss der Fattal Hotels Fund L.P., Zypern, einbezogen.
